Can Police Officers and Firefighters Sue for On-the-Job Injuries?

As a result of conflicting rulings over the years, confusion remains on whether New Jersey emergency service personnel, such as police officers and firefighters, have the right to seek recovery and damages after suffering injury, disease or death while performing official duties.

 

Of course, the likelihood of harm is high due to the job responsibilities, as is the possibility of negligence.

 

Fortunately, emergency service personnel now have the same legal rights as all other citizens. But that wasn’t always the case, especially for firefighters and police officers.

 

Adopted by the New Jersey Supreme Court in 1960, the “firefighters’ rule” prevented firefighters, police officers and other types of emergency personnel from seeking damages for on-the-job injuries. Courts essentially stated firefighters and police officers “assumed the risks” of their dangerous profession and couldn’t file civil lawsuits against property owners for personal injuries, even if negligence was involved.

 

So any emergency service personnel injured as a result of someone else’s negligence were unable to receive compensation. They were limited to worker’s compensation benefits to help with their injuries.

 

Also, if there was a long road to recovery, firefighters and police officers faced the possibility losing their jobs and the ability to provide for their families – all without any recourse.

 

In 2006, the Appellate Courts of New Jersey upheld the Fireman’s Act signed into law by former Governor Jim Florio in 1995. The law gives emergency service personnel the right to sue for injury or death which might be either “directly or indirectly the result of neglect, willful admission, or willful or culpable conduct of any person or entity, other than the law enforcement officer, firefighter or first aid ambulance or rescue squad member.”

Firefighters must be able to deal with life threatening situations with the calm confidence that saves lives. They are able to control their emotions and stay focused on the task at hand. With your emotions in check you would be able to handle daily stress activities with a calm logical focus. 

The ability to self motivate and make decisions while using common sense not only helps to keep a firefighter alive but can also help you in your daily activities be more successful. They are resourceful, able to determine priorities and can complete complex task while trying to save lives. A firefighter also can sometimes act as a councilor while being supportive and empathetic. They stand up for what they believe in and live by their ethical and moral code. This is something that we all start out doing, but as time moves on it is growing steadily harder to stick to your own moral compass. 

Those of us who know firefighters as friends or family know that those are just some of the more professional characteristics that they are known by. We know how courageous and brave they are in the face of danger. They have this complete willingness, almost a need, to help other people. Firefighters display good judgment, honesty and creativity in order to do what is necessary to save lives. 

There is just something to be said about someone who is so willing to lay their life of the line every day of the year. This is where their selfless characteristics are so truly amazing. They work excellently as a team and believe in leaving no one behind. 

The characteristics of a firefighter may not be perfect all the time, but no one is. They are definitely someone that you can look up to while continuing to work on our own characteristics. Nothing ever stays the same and just like a firefighter who is always learning and strengthening new skills we must continue to grow by learning from others.

a house is on fire, everyone is running out and a firefighter is
running in!  They are great at what they do, plus they save a lot of
lives. About 90 per cent of firefighters have second jobs.  Most of them are really
hard labor jobs.  My husband is a retired firefighter and his second
job was washing windows and cleaning carpets.  All though it was a
very successful business, it still was hard work, and gave him no time
at home with his family.  Most firefighters work 24hr shifts which
takes them away from their family. Having a second job gives them no
time at all, they miss out on a huge portion of their families lives, just to achieve financial freedom. With the way our economy is, firefighters pensions are half or less of
what they earned while working.  That makes it real hard for them to
live the life their accustomed  to.  And forget about going back to
work as a firefighter after retiring, there are to many young people
to do the job. Well my husband and I found a solution for all this. Even though my
husband is retired, it is never to late to start an easy business, an
internet marketing business.  Firefighters can continue doing what
they love, fighting fires and saving lives and the internet marketing
business can be done at home on their days off.  Still spend time with
their family and friends and not worry about a small pension for
retirement. It will give firefighters the financial freedom they desire!
